Terms of service
Welcome to CosmicLeads.Net (“CosmicLeads,” “we,” “us,” “our”). We provide real estate professionals with daily expired listing leads delivered digitally. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy and Refund Policy.
CosmicLeads is powered by Shopify. Sales are made by CosmicLeads; Shopify is not a party to your transaction.
1) Eligibility & Accounts
You must be at least 18 (or the age of majority in your jurisdiction). You’re responsible for the accuracy of information you provide and for maintaining the security of your account. Do not share your login or grant access to non-authorized users.
2) What We Provide (Digital Data Only)
We deliver time-sensitive digital data: daily expired listings for South Florida with owner phone numbers. Delivery is by email (and/or link) typically at 8:00 AM ET. Times are targets, not guarantees (see §11).
No physical goods are shipped.
3) Subscriptions, Billing & Auto-Renewal
Plan: All 5 counties (Miami-Dade, Broward, Palm Beach, Port St. Lucie, Martin).
Price: $99.99 per 30 days, auto-renews until canceled.
Billing is processed via Shopify/Seal Subscriptions using your payment method on file.
You may cancel anytime; cancellation takes effect at the end of the current billing period and stops future renewals.
Updating your payment method authorizes us to continue charges to the new method.
4) No Refunds / Final Sale
Because access to our data is delivered digitally and has immediate value, all sales are final. We do not offer refunds or pro-rations once a billing cycle starts, regardless of usage. See Billing Error Corrections (§5) for the only exceptions we correct.
5) Billing Error Corrections
We will fix clear billing mistakes (e.g., duplicate charge, accidental duplicate subscription, confirmed fraud). Once verified, we’ll void or credit the erroneous charge. Posting times depend on your bank/card provider.
6) Free Sample
We may offer a one-day free sample so you can evaluate quality before subscribing. Sample access may be limited, non-transferable, and subject to eligibility and anti-abuse checks.
7) Permitted Use & License
Subject to these Terms and payment of fees, we grant you a limited, non-exclusive, non-transferable license to use the delivered data for your own real estate prospecting.
You may not:
resell, redistribute, sublicense, publish, or share our data with third parties;
use the data for any illegal, harassing, or deceptive activity;
scrape, copy, or reverse-engineer our site or delivery systems;
misrepresent the origin of the data or remove proprietary notices.
We may monitor for abuse and suspend or terminate accounts that violate these Terms.
8) Compliance & Calling Rules
Data is provided for prospecting purposes only. You are solely responsible for all compliance, including but not limited to:
DNC / telemarketing laws, TCPA, state/federal calling rules;
brokerage policies and local regulations;
obtaining any required consents for SMS or automated dialing you perform.
We may scrub numbers against public lists, but you must run your own compliance process before contacting any consumer. We do not guarantee any particular number is callable in your jurisdiction.
9) Email & SMS Communications
If you provide a phone number and consent, you agree to receive service and marketing SMS from us; message/data rates may apply. You can opt out of marketing SMS at any time (service/transactional notices may still be sent). We deliver daily lists primarily by email—please whitelist our address and keep your contact info current.
10) Data Accuracy; No Professional Advice
We use multiple sources and skip-tracing methods to improve accuracy, but data can contain errors, be incomplete, or change. We do not warrant lead quality, conversion, or outcomes. Nothing in the Services is legal, financial, or brokerage advice.
11) Availability & Delivery
We aim to deliver at 8:00 AM ET daily; however, delays or interruptions may occur (maintenance, third-party outages, holidays, force majeure). We provide the Services on a commercially reasonable efforts basis, “as is” and “as available.”
12) Intellectual Property
All content, data formats, graphics, text, logos, and the site design are owned by CosmicLeads or its licensors and are protected by IP laws. Except for the limited license in §7, no rights are granted. “CosmicLeads” and related marks are our trademarks.
13) Third-Party Tools & Links
We may integrate third-party tools (e.g., Shopify, email/SMS providers, file hosts). Use of those tools is as is and governed by their terms. We are not responsible for third-party sites or services.
14) Relationship with Shopify
CosmicLeads uses Shopify to power the store, but your purchase is with CosmicLeads, not Shopify. You release Shopify from claims arising from your transactions with us.
15) Feedback
If you submit ideas or feedback, you grant us a perpetual, worldwide, royalty-free license to use them without obligation or compensation.
16) Disclaimer of Warranties
EXCEPT AS REQUIRED BY LAW, THE SERVICES AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOUR USE IS AT YOUR OWN RISK.
17) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMICLEADS (AND OUR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO COSMICLEADS IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
18) Indemnification
You agree to defend, indemnify, and hold harmless CosmicLeads from claims or losses arising from your use of the Services, your breach of these Terms, or your violation of law (including telemarketing and DNC rules).
19) Termination
We may suspend or terminate access for any violation of these Terms or suspected abuse. You remain responsible for fees incurred up to termination. Sections that by nature should survive will survive (including §§7–19, 21–24).
20) Changes to Services or Pricing
We may update features, content, or pricing from time to time. Material changes to pricing or these Terms will be communicated as required by law.
21) Governing Law & Venue
These Terms are governed by the laws of the State of Florida, USA, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state or federal courts located in Florida for any dispute arising out of these Terms or the Services.
22) Severability; Waiver; Assignment; Entire Agreement
If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms (plus referenced policies) are the entire agreement between you and CosmicLeads.
23) Updates to These Terms
We may update these Terms periodically. The “Last updated” date will reflect the latest version. Your continued use after changes take effect constitutes acceptance.
